Solid Waste, Garbage Bag Tag and Landfill Fees

THE TOWN OF SOUTH BRUCE PENINSULA

NOTICE OF INTENTION TO PASS BY-LAW

AMENDED JULY 12TH, 2007

To amend set fees for the solid waste, garbage bag tag fees and landfill fees for the municipality.

TAKE NOTICE that the Corporation of the Town of South Bruce Peninsula will consider
passage of a by-law pursuant to the Municipal Act 2001 to amend set fees for the solid waste,
garbage bag tag fees and landfill fees for the municipality as follows:

AND FURTHER TAKE NOTICE that any person who claims that they may be prejudicially
affected by such fee amendments may submit comments in writing to the Council of the Town of
South Bruce Peninsula or appear at the regular Council meeting on Monday, July 30, 2007 at
7:30 pm.

Please note: the previous amendment dated June 7th, 2007 has been revised to increase the fee
for brush to $95.00/tonne from $2.00 per load and therefore public input has been extended to
July 30th, 2007.

THE CORPORATION OF THE TOWN OF SOUTH BRUCE PENINSULA

BY-LAW NUMBER 49-2007
A By-law to set fees for the Solid Waste, Garbage Bag Tag Fees
and Landfill Fees for the Town of South Bruce Peninsula

WHEREAS the Corporation of the Town of South Bruce Peninsula wishes to enact a
consolidated fee by-law for the collection of solid waste, garbage bag tag fees and landfill
fees.

AND WHEREAS Section 391.1 of the Municipal Act, 2001 states that a municipality
may pass by-laws imposing fees or charges on any class of persons for services or
activities provided or done by or on behalf of it; for costs payable by it for services or
activities provided or done by or on behalf of any other municipality or local board; and
for the use of its property including property under its control.

NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN
OF SOUTH BRUCE PENINSULA ENACTS AS FOLLOWS:

1. THAT all fees outlined in Schedule "A" to this by-law are hereby in force and
effect as of September 3, 2007 or such other date specified by any amending by-
law.

2. It is intended that all provisions of this by-law shall be binding and effective. In
the event that any particular provision or provisions or part of a provision is found
to be void, violable or unenforceable for any reason whatever, then the particular
provision or provisions or part of the provision shall be deemed severed from the
remainder of this by-law and all other provisions shall remain in full force.

3. That this by-law supersedes any by-law or fee in any other by-law not consistent
with this by-law.

4. That non payment of the bi-monthly billing on the due date specified therein shall
result in a penalty of 2 percent being added and thereafter a penalty of 2 percent
will be added on the last day of each and every month the default continues.

5. This by-law shall be known as the "Category 1 Fee By-law- Disposal of Solid
Waste, Garbage Bag Tag Fees and Landfill Fees, 2007".

6. This by-law shall come into full force and effect on September 3, 2007.

Disposal of Solid Waste (plus G.S.T.)

B.O.D. strength over 2000 mg/L $32.50 per cubic metre

Type #2*
B.O.D. strength under 2000 mg/L $13.50 per cubic metre
*Must provide report completed by
Engineer and a minimum of 6 months
data showing reduced B.O.D. to qualify
for Type #2 rate.


Garbage Bag Tag Fee (no G.S.T.)

- Household waste $ 95.00 per tonne (minimum $5.00)

demolition work sites and/or delivered by
commercial hauler)

c) Contaminated Soil (M.O.E. approved) $ 95.00 per tonne

The Town must be out of it's collective mind. Many people already place brush on the beach and lake bottom when the cost is only $2.00.

Why not start using the brush and other organic material to start composting and for other environmentally friendly uses?

One missing item in the Bruce is good topsoil. It could be profitable to sell compost, leaf mould, and landscape chips.
