Draft Proposed Terms of Reference

As part of the Drinking Water Source Protection Program, the Source Protection
Committee for the Saugeen, Grey Sauble, Northern Bruce Peninsula Source Protection
Region has prepared Draft Proposed Terms of Reference documents under section 8 of
the Clean Water Act, 2006, for the development of Assessment Reports and Source
Protection Plans.


A separate Draft Proposed Terms of Reference has been created for each Source
Protection Area in our Region:
- Saugeen Valley Source Protection Area
- Grey Sauble Source Protection Area
- Northern Bruce Peninsula Source Protection Area


The Terms of Reference is essentially a work plan that identifies what specific work
items or tasks must be completed to develop an Assessment Report and a Source
Protection Plan for each Source Protection Area. The Terms of Reference also describes
municipal drinking water systems within the Source Protection Areas. It stipulates what
agencies will be responsible for the various tasks, the date by which each task will be
completed, and the estimated cost of each task.


PUBLIC MEETINGS

Public meetings have been scheduled where members of the public can inspect the Draft
Proposed Terms of Reference, speak with members of the Source Protection Committee
and staff, and submit comments.

Terms of Reference Summary Document

1) Background

Drinking Water Source Protection (SP) is a resource planning process that aims to keep sources
of drinking water safe and usable. Following the Walkerton water tragedy from the year 2000,
the Walkerton Inquiry led by Justice Dennis O'Connor, made 121 recommendations for the
improvement drinking water delivery in Ontario. Various regulations were created or
strengthened in the areas of testing, operator training, reporting, inspection and other aspects of
drinking water systems. Justice O'Connor also spoke of a `multi-barrier approach' to safe
drinking water where protection of drinking water sources was the first barrier. A total of 22
recommendations from the Report of the Walkerton Inquiry related to source protection.

The Walkerton Report stressed the need for planning to fit the functioning of ecosystems and
recommended watersheds as the basis for the protection and enhancement of natural systems
toward safeguarding sources of drinking water. Watersheds are areas of land drained by a river
or stream into a common body of water (for our purposes Lake Huron or Georgian Bay).

The Clean Water Act, 2006, came into effect on July 3, 2007, and requires Source Protection
Plans to be developed for watersheds in Ontario. Regulations were approved on July 3, 2007,
that set out requirements for the Source Protection Committee (SPC) and give timelines for the
preparation of the Terms of Reference, Assessment Report and Source Protection Plans. Forty
Source Protection Areas (SPA) were established in Ontario. The regulations also allowed for
SPAs to be grouped together into Source Protection Regions. Locally, the Saugeen Valley SPA,
Grey Sauble SPA and Northern Bruce Peninsula SPA have been established and comprise the
Saugeen, Grey Sauble, Northern Bruce Peninsula Source Protection Region.


2) Introduction

The purpose of this document is to provide general information on the Terms of Reference (T of
R), what they will include and how they will be developed. It is meant to accompany the more
detailed Terms of Reference document that has been developed from the Ministry of the
Environment database template. Submitting these two documents in a complementary manner
will ensure a general understanding of the Terms of Reference process locally, as well as fulfill
the requirements of the legislation. Using the database will also ensure a standardized Terms of
Reference format amongst the 19 Source Protection Regions across the Province. Details on
how to complete certain tasks will be available in regulations, Director's rules, and guidance
when these materials are developed.

In the Summary Document, information is given on the jurisdictions within the SPR and the
function of the Source Protection Committee. Details on three key program deliverables,
timelines for submission of documents and steps in the Terms of Reference process are outlined.

As well, a listing of the municipal drinking water systems and overview of the tasks to be
completed gives a synopsis of the scope of the work that is presented in very detailed fashion
within the Terms of Reference document.


3) Source Protection Region

The Saugeen, Grey Sauble, Northern Bruce Peninsula Source Protection Region is one of
nineteen Source Protection Regions in the Province of Ontario. It has an area of approximately
8500 sq km and a population of just over 157,000. It includes most of Grey and Bruce Counties
and smaller portions of Huron and Wellington Counties. It also contains all, or portions of, 21
lower tier municipalities (see Table 1 and Map 1). The Region is home to two First Nation
communities, the Chippewas of Nawash at Cape Croker on Georgian Bay and the Chippewas of
Saugeen on the Lake Huron shoreline near Southampton. The Source Protection Region also
includes the jurisdictions of the Saugeen Valley Conservation Authority and the Grey Sauble
Conservation Authority.

The SPR is a partnership of three agencies: the Saugeen Valley Conservation Authority, the
Grey Sauble Conservation Authority and the Municipality of Northern Bruce Peninsula.
Regulations associated with the Clean Water Act established the jurisdictions of these three
organizations as Source Protection Areas and gave the Conservation Authority Boards and the
Municipal Council additional responsibilities as Source Protection Authorities (SPA). SPAs are
to provide direction, support and resources to the SPC in all aspects of the program. They also
participate in the preparation of annual work plans, budgets and reports. SPAs have the
responsibility of reviewing and processing the proposed Terms of Reference, Assessment
Reports and Source Protection Plans.

The Saugeen Valley Source Protection Area encompasses the jurisdiction of the Saugeen
Valley Conservation Authority. About 90,000 people (2001 Census) live in this area, which
covers approximately 4675 sq km. The major watershed is the Saugeen River, which is also the
third largest watershed in Southern Ontario. The Penetangore River, Pine River and smaller lake
fringe watersheds that also drain into Lake Huron are part of the Saugeen Valley SPA.

The Grey Sauble Source Protection Area comprises approximately 3146 sq km and
corresponds with the jurisdiction of the Grey Sauble Conservation Authority. The population is
about 63,000 people (2001 Census). The Sauble River, with the largest catchment area in the
Grey Sauble SPA, drains into Lake Huron. Four large watersheds drain into Georgian Bay,
namely the Beaver, Bighead, Sydenham and Pottawatomi Rivers. In addition, there are a
numerous other creeks and long stretches of lake fringe that drain directly into Georgian Bay or
Lake Huron. The Niagara Escarpment is a dominant feature in many parts of the Grey Sauble
SPA.

The Northern Bruce Peninsula Source Protection Area encompasses the Municipality of
Northern Bruce Peninsula, with an area of 761 sq km and a population of 4,048 residents (2001
Census). The Niagara Escarpment winds close to the Georgian Bay shoreline, while the middle
parts of the municipality are relatively flat and the Lake Huron shoreline has many shallow bays.
The Municipality of Northern Bruce Peninsula was created in 1999 by an amalgamation of the

Village of Lion's Head, Township of St. Edmunds, Township of Lindsay and Township of
Eastnor. The islands and waters off the northern tip of the Bruce Peninsula are part of Fathom
Five National Marine Park. Extensive portions of Northern Bruce Peninsula near Tobermory (in
the former St. Edmunds Township) are designated Bruce Peninsula National Park. The two parks
were established in 1987.

4) Source Protection Committee (SPC)

In this Region, the Drinking Water Source Protection program is guided by a 16 person Source
Protection Committee made up of a chairman, who lives in the region but was appointed by the
Minister of the Environment, and 15 local individuals representing various sectors. Committee
members represent municipalities, agriculture, business, health, environment and the general
public.

The SPC is responsible for guiding the development of major technical and planning documents
related to the program. These documents will contain policies designed to protect our sources of
drinking water by addressing significant threats to those sources.

Shortly after the formation of the Source Protection Committee, members participated in a
strategic planning session to develop a mission statement and guiding principles.

5) Program Deliverables

The SPC is responsible for guiding the creation of three Drinking Water Source Protection
Program documents. These are: the Terms of Reference, the Assessment Report and the Source
Protection Plan. These three documents will be developed for each of the three Source
Protection Areas that make up the Saugeen, Grey Sauble, Northern Bruce Peninsula Source
Protection Region.

The Terms of Reference document is essentially a work plan that identifies what specific work
items or tasks must be completed to develop an Assessment Report and a Source Protection Plan
(SPP) for each Source Protection Area (Map 1). The Terms of Reference also describes
municipal drinking water systems within the Source Protection Areas (Tables 2-4). It will also
stipulate what agencies will be responsible for the various tasks, the date by which each task will
be completed, and the estimated cost of each task. Note: The Ministry of the Environment has

not released regulations for either the Assessment reports or the Source Protection Plans. As a
result, the Terms of Reference documents may require amendments once these regulations are
released.

The Assessment Report is a comprehensive document that will describe the watershed, identify
vulnerable areas where a drinking water source may be at risk of contamination, and assess
threats to drinking water within the vulnerable areas. It will also provide information on water
quantity and the risks associated with it. Much of the background work necessary to develop an
assessment report has been completed or is underway.

The Source Protection Plan will provide policies to address significant risks to the quality and
quantity of drinking water sources within the region.


6) Timelines

The Source Protection Committee is required to submit the proposed Terms of Reference to the
appropriate Source Protection Authority by August 20th, 2008. The SPA must review and
comment on the document, and submit it to the Minister of the Environment by October 20th,
2008.

The Assessment Report is to be forwarded to the Director 1 year after the approval of the Terms
of Reference which is estimated to be around November, 2009.

The Source Protection Plan must be forwarded to the Minister before the 5th anniversary of the
appointment of the SPC Chair which is August 20, 2012.

A chart showing the timelines for the Drinking Water Source Protection program is shown in
Appendix A.


7) Terms of Reference Process

The development of the Terms of Reference, as required by Regulation 287/07 of the Clean
Water Act, 2006, is a complex process involving municipalities, First Nations, the public, other
SPCs and, of course, our three Source Protection Authorities. There are six major steps
involved.

Step 1: Notice of Commencement
The legislation requires that notification be sent to all municipalities and First Nation
communities within the Region advising them that the process of developing the T of R is about
to commence and inviting them to be part of this process. These notices were sent out on
January 9, 2008.

Step 2: Developing Draft Proposed Terms of Reference
Staff are developing various drafts of the T of R for presentation to the SPC. Municipal councils
have been approached and advised concerning opportunities for them to be involved in the

preparation of the Assessment Report and the Source Protection Plan. The Terms of Reference
will indicate the involvement of the municipalities within the region. The SPC will be asked to
approve the final draft of the Proposed T of R at the May 2008 meeting.

Step 3: Consulting of Draft Proposed Terms of Reference
Once the draft proposed T of R are completed and approved by the SPC, they are published on
the internet as well as being made available at various locations across the Region. They are also
circulated to municipalities, FN, other SPCs, etc. A notice is published advising the public of the
legislatively required 35 day commenting period. Three public meetings, one in each of the
three Source Protection Authorities, will also be held.

Step 4: Finalizing Proposed Terms of Reference
The SPC will review all comments received concerning the draft proposed T of R. From this
review the Proposed T of R will be prepared and the SPC will be asked to approve them at their
meeting of July 22, 2008.

Step 5: Consulting on Proposed Terms of Reference
Once approved by the SPC, the Proposed T of R will be forwarded to the three SPAs, the Chiefs
of the First Nations bands, and all the municipalities within the Region. They are required to be
published on the internet but can also be made available to the public in such a manner as the
SPC feels is appropriate. This must be done by August 20, 2008. The public is again invited to
comment and is given 30 days to do so. These comments are to be directed to the Source
Protection Authorities.

Step 6: Submitting Proposed Terms of Reference
The Source Protection Authorities will review and summarize all the comments on the proposed
T of R from the various sources. The SPA will then submit the proposed Terms of Reference
with comments to the Minister. The deadline for this submission is October 20, 2008.

9) Overview of Tasks

A number of tasks (Appendix B) listed in the Terms of Reference are general in nature and apply
to the entire Source Water Protection Region. Other tasks are specific to individual municipally
owned and operated drinking water systems. The upper tier municipalities within the Source
Protection Region do not operate municipal drinking water systems. The lower tier
municipalities within the Region own and operate a variety of drinking water systems. Generally
speaking, those urban areas along the shorelines of Lake Huron and Georgian Bay rely on the
Great Lakes as their source of drinking water, while the inland urban communities rely on
groundwater sources.

Describing the overall flow system dynamics for each watershed in the source protection area
taking into consideration surface water and groundwater features, land cover (e.g. proportion of
urban vs. rural uses), human-made structures (e.g. dams, channel diversions, water crossings),
and water takings. Details on how to complete this task will be available in the Assessment
Report regulation, Director's rules, and guidance when they are developed.

6. Conducting a tier 1 water budget analysis and stress assessment
Conducting a tier 1 water budget analysis, stress assessment, and delineation of significant
groundwater recharge areas. May also include the identification of water quantity concerns and
an analysis of uncertainty. Details on how to complete this task will be available in the
Assessment Report regulation, Director's rules, and guidance when they are developed.

7. Conducting a tier 2 water budget analysis and stress assessment
If determined necessary from a tier 1 water budget analysis and stress assessment, conducting a

groundwater recharge areas. May also include the identification of water quantity concerns and
